WARRANTY

Contemporary Carbide Technologies' products are warranted to be free from all material and workmanship defects. This warranty is in lieu of and excludes all other warranties whether expressed or implied by operation of law or otherwise including any warranty of merchantability or fitness for a particular purpose. If any product in any way fails to meet specifications, or is defective in any way, it may be returned to the factory for inspection upon receipt of definite shipping instructions. A fair and equitable adjustment, or full replacement will be made if found defective. Contemporary Carbide Technologies shall not be liable for damage, loss or expense directly or indirectly arising from the use of the material or from any other cause, the exclusive responsibility of Contemporary Carbide Technologies being to require the replacement of repair of defective material or workmanship or from any other cause unless made in writing within 30 days of the receipt of the goods to which such claim relates.

It is expressly understood that any technical advice furnished by seller with respect to the use of its goods or services is given with out charge and seller assumes no obligation or liability for the advice given of results obtained. All such advice being given and accepted at the buyer's risk.

Manufacturers and seller will not be liable for consequential, incidental, or and damages other than repair or replacement of defective goods or refund of the purchase price paid for such defective goods at manufacturers or sellers option.

If the goods sold hereunder are to be prepared or manufactured according to buyer's specifications, buyer shall indemnify, defend or hold harmless the seller against any claims or liability for patent or trademark infringement on account of such preparation or manufacture.

All questions arising in connection with the quotation, any order submitted in connection therewith, the acknowledgement or counteroffer made in response to any such order or the sale of the goods covered hereby shall be resolved in accordance with the laws of the state of Florida.
